01 The formula

How Gratuity Is Worked Out

Gratuity is 15 days of your last wages for every year you served, counting a month as 26 days. On ₹50,000 a month for 10 years that is ₹2,88,462.

Last wages₹50,000

Gratuity₹2,88,462
A month counts as 26 days. For every year you work, 15 of those 26 days of wages are paid to you as gratuity.
Read the full explanation

The formula is last drawn wages × 15 ÷ 26 × years of service. Wages means basic pay plus dearness allowance (DA) if your pay has one. HRA, special allowance, bonus and overtime are left out.

Why 26? The law treats a month as 26 working days, so 15 days of wages is 15/26 of one month's wages: ₹28,846 for every year on a ₹50,000 basic.

Gratuity does not depend on whether you resign, retire or are let go. What matters is how long you served, and the wages you were drawing at the end.

02 Years and months

How Months Of Service Are Counted

A part-year counts only when it is more than six months. 7 years 6 months counts as 7 years; 7 years 7 months counts as 8.

7 years 7 months₹2,30,769counts as 8 years

On a ₹50,000 basic. Grey months are left out; green months round the service up to the next year.
Read the full explanation

Only completed years earn gratuity, with one exception: a leftover period of more than six months is rounded up to a full year. Exactly six months is not more than six, so it is left out.

On ₹50,000 a month, 7 years 6 months gives ₹2,01,923 and 7 years 7 months gives ₹2,30,769: one extra month of service is worth ₹28,846.

This is why the calculator asks for years and months separately. If you are close to a round-up, a single month can change the result.

03 Who gets it

How Many Years You Need

You need 5 years of service to be paid gratuity when you leave. A fixed-term employee needs 1 year. On death or disablement there is no minimum.

Permanent employee 5 years
Fixed-term employee 1 year
Death or disablement No minimum
Gratuity is paid from the lock onward. The rail runs from 0 to 10 years of service.
Read the full explanation

The 5-year rule is the standard one for permanent employees, and the labour codes keep it. What changed from 21 November 2025 is that a fixed-term employee now qualifies after 1 year, paid in proportion to the time served.

If you are a little short, the calculator tells you how many months are left and what you would get. For example, at 4 years and 9 months on a ₹50,000 basic you are 3 months away from about ₹1,44,231.

Rules about how a "year of service" is counted for someone who worked fewer days, or who changed employers, are not modelled here. Ask your HR team if you are close to the line.

04 Which salary

Which Salary Counts: The 50% Rule

From 21 November 2025, wages for gratuity are at least 50% of your total pay. If basic is ₹30,000 of ₹1,00,000, gratuity is worked on ₹50,000, not ₹30,000.

Read the full explanation

The Code on Wages defines wages as basic plus DA, but says that if the other allowances add up to more than half of your total pay, the extra is added back. So a low basic no longer shrinks gratuity.

In the example, 10 years of service gives ₹1,73,077 on a ₹30,000 basic and ₹2,88,462 once the 50% rule is applied: ₹1,15,385 more.

Whether your employer applies this to your payslip yet is their call. The calculator shows both: leave "Total monthly pay" empty for the plain formula, or fill it in to see the 50% rule.

05 Cap and tax

The ₹20,00,000 Cap And What Is Tax Free

The law caps gratuity at ₹20,00,000. Up to ₹20,00,000 of it is tax free for a private-sector employee; anything above is added to your taxable income.

Years of service until gratuity reaches the cap

₹75,000 basic Not in a career
₹1,00,000 basic 35 years
₹1,50,000 basic 24 years
₹2,00,000 basic 18 years
₹3,00,000 basic 12 years
The rail runs from 0 to 45 years of service.
Read the full explanation

The cap matters mostly to long-serving, higher-paid employees. On a ₹1,00,000 basic you reach it after 35 years of service; on a ₹2,00,000 basic, after 18. On a ₹75,000 basic it does not happen in a working life.

The tax-free limit of ₹20,00,000 is across your whole working life, not per employer. If you have already received tax-free gratuity from an earlier job, less of the limit is left.

Central and state government employees are paid under their own pension rules and get all of their gratuity tax free. This calculator is for employees who are paid under the gratuity law, in the private sector and in most public companies.

07 In your CTC

Gratuity Inside Your CTC

Your employer sets aside 15/26 of a month's wages for you every year, about 4.81% of wages. It sits in your CTC but never in your bank.

See the full breakup of your CTC →

Read the full explanation

That share is the "gratuity" line in your CTC breakup. On a ₹50,000 basic it is ₹2,404 a month. It reaches you only when you leave, and only if you have served the minimum years.

This is also why changing jobs before five years can quietly cost you: the money the company set aside for you over those years is not paid out.

08 Questions

Questions About Gratuity

How do I calculate gratuity?

Multiply your last drawn wages (basic plus DA) by 15, divide by 26, and multiply by your years of service. On ₹50,000 a month for 10 years: ₹50,000 × 15 ÷ 26 = ₹28,846 a year, × 10 = ₹2,88,462.

How many years of service do I need to get gratuity?

5 years of continuous service for a permanent employee, and 1 year for a fixed-term employee under the labour codes. On death or disablement no minimum applies.

How is gratuity calculated in months?

Enter your completed years and the months beyond them. A leftover period of more than 6 months counts as a full year; 6 months or fewer is dropped. 7 years 7 months counts as 8 years, 7 years 6 months as 7.

Is gratuity calculated on basic salary or on CTC?

On wages: basic plus DA, not on CTC. Under the labour codes, wages are at least 50% of your total pay from 21 November 2025. With a ₹30,000 basic out of ₹1,00,000 a month, wages are ₹50,000.

Is there a maximum limit on gratuity?

Yes. The law caps gratuity at ₹20,00,000. On a ₹1,00,000 basic you reach the cap after 35 years. Your employer may pay more by contract.

Is gratuity taxable?

For a private-sector employee, gratuity is tax free up to ₹20,00,000 over your working life. Anything above that is taxed as salary. Central and state government employees get all of it tax free.

Is gratuity included in my CTC?

Usually yes: employers count 15/26 of a month's wages a year, about 4.81% of wages, as the "gratuity" line of your CTC. It is not paid in your monthly salary. On ₹50,000 wages it is ₹2,404 a month.

Do I get gratuity if I resign?

Yes. Resigning, retiring and being laid off all pay gratuity once you have served the minimum years. Only the length of service and your last wages matter.

Does this calculator work for government employees?

No. Central and state government employees are paid under their own pension and gratuity rules, with a different formula. This calculator follows the gratuity law that covers private companies and most public ones.

What did the 50% wages rule change?

Before 21 November 2025, a low basic meant a low gratuity. Now wages cannot be less than 50% of total pay: on ₹30,000 basic of ₹1,00,000, 10 years of service gives ₹2,88,462 instead of ₹1,73,077.
